Binding Arbitration offers a less formal and more cost-effective alternative to court for resolving personal property disputes or other limited issues agreed upon by the parties. This process allows families to avoid prolonged litigation while still obtaining a final, enforceable decision from a neutral third party.

How Arbitration Works:

The scope and format of the arbitration are typically tailored to the nature of the dispute and may vary in complexity:

  • In more detailed matters, the arbitration may involve:

    • Asset valuation

    • Appraisals

    • A formal hearing with evidence and testimony presented to the arbitrator

  • In simpler cases, the parties may:

    • Submit written documentation

    • Provide a list of assets and values (agreed-upon or disputed)

    • Allow the arbitrator to make a determination based on those submissions

The cost and structure of the arbitration process are either agreed upon in advance by the parties or directed by the arbitrator, depending on the situation.

At the conclusion of the process, the arbitrator issues a written decision that is binding on both parties, carrying the same weight as a court order.
