Traci Capistrant has devoted over 37 years to practicing Family Law. Her extensive experience ranges from simple, uncontested divorces to complex custody and financial matters. She has handled a wide variety of cases, including third-party custody, paternity, dissolution, post-decree enforcement, step-parent adoption, child support enforcement and modification, parenting time, custody disputes, and numerous other family-related issues.

Beginning January 1, 2026, Traci transitioned away from litigation to focus exclusively on helping parties resolve disputes outside of the courtroom. Her services are designed to facilitate settlement and avoid the emotional and financial toll of trial.

Family law matters are often deeply emotional and stressful. Feelings of anger, sadness, betrayal, and confusion can make it difficult to navigate the process and focus on what truly matters. Traci brings an empathetic and balanced approach, helping clients manage these emotions while working toward resolution. She uses a variety of methods to assist parties, including:

  • Arbitration

  • Early Neutral Evaluation (ENE)

  • Parenting Consulting

  • Parenting Time Expediting

  • Moderated Settlement Conferences

 

Although she remains a licensed attorney, Traci now practices exclusively in the area of Alternative Dispute Resolution (ADR). As a Rule 114 Qualified Neutral, she has received specialized training in mediation and moderated settlement conferencing. In this neutral role, she facilitates communication between parties and helps them reach resolution—without taking sides or providing legal advice. She has mediated complex custody, financial, and parenting time cases across the State of Minnesota.

 

Traci is also trained as both a Social ENE and Financial ENE evaluator. These processes are designed to help families resolve custody, parenting time, asset division, and support issues without the need for prolonged litigation. She is available to serve as an ENE evaluator in the following Minnesota counties:

  • Hennepin

  • Ramsey

  • Sherburne

  • Washington

  • Wright

 

In addition, Traci serves as a Parenting Consultant, Parenting Time Expeditor, and Personal Property Arbitrator. In these decision-making roles, she helps families reach agreements concerning their children or the division of personal property—including pets. These services allow families to resolve disputes comprehensively and collaboratively, without involving the court.

A native of North Saint Paul, Minnesota, Traci earned her B.S. in Business Administration from the University of Minnesota in 1985. She received her J.D. from William Mitchell College of Law, graduating cum laude in 1988.

Traci began her legal career at Oppenheimer, Wolff & Donnelly, focusing on insurance coverage, employment law, and products liability. In 1991, she shifted to Family Law by joining Peterson, Fishman & Livgard, P.A., becoming a named partner in 1993.

In 2001, she launched her own firm, Capistrant Law, P.A., exclusively focused on family law. In 2020, she partnered with Dan Van Loh to form Capistrant Van Loh, P.A., emphasizing both family law and conflict resolution. On January 1, 2026, Traci established Capistrant Family Solutions, LLC, a full-service ADR practice.
