Parenting Time Expeditor (PTE)
Neutral assistance for resolving parenting time disputes efficiently and respectfully.
A Parenting Time Expeditor helps parents resolve disagreements about existing parenting time orders without returning to court. Focused on interpretation, enforcement, and day-to-day scheduling issues, the PTE provides a structured, confidential process that supports cooperative co-parenting and minimizes conflict.
A Parenting Time Expeditor (PTE) is appointed by court order under Minnesota Statute § 518.175, subd. 1(b) to help parents resolve disputes related to an existing parenting time order. The role of the PTE is limited to interpreting and enforcing current parenting time provisions—the PTE cannot modify custody or create a new parenting time schedule.

Scope and Common Issues:

The PTE helps resolve day-to-day parenting time disagreements, such as:

-
Holiday and vacation scheduling
-
Temporary adjustments to parenting time
-
Disputes over pick-up/drop-off logistics
-
Clarification of vague or ambiguous language in the existing order
How the PTE Process Works:

1. Initial Attempt at Resolution:
Before involving the PTE, parents are expected to attempt to resolve their disagreement directly.
2. Written Submission:
If the issue remains unresolved, each party submits their concerns in writing to the PTE.
3. Joint Meeting:
The PTE typically holds a joint session to facilitate discussion and explore resolution options.
4. Decision-Making:
If agreement cannot be reached, the PTE will consider the information from both parents—and any relevant outside information, as needed—to make a binding written decision. This decision carries the full force and effect of a court order.
5. Challenging a Decision:
PTE decisions may be challenged in court, but only in the manner and timeframe specified in the Order Appointing the PTE.
6. The PTE process is confidential. Communications with the expeditor cannot be shared with the court unless a written decision is issued.

Fees and Duration:

-
A retainer is typically required and must be maintained throughout the appointment.
-
Fees are generally shared equally, unless the PTE determines otherwise due to one party’s conduct.
The standard term for a PTE appointment is two years, although this may be modified based on the parties’ agreement.
